PPPs IN THE POWER INDUSTRY: REGULATORY, FINANCE AND CONTRACTING METHODS IN AFRICA

It is now a common phenomenon for Governments in Africa to enter into partnerships with the Private Sector in the development of infrastructure for purposes of fueling economic development and improving service delivery. The Energy Sector in Africa has been one of the most recent beneficiaries of Public-Private Partnerships (PPPs). Delivering modern and reliable power infrastructure is essential to foster economic growth in Africa. Different models of PPPs have been applied in the development of generation and transmission projects. Designing, planning, structuring, implementing and operating such PPPs involves highly tactical expertise, back to back negotiations involving Government Agencies, Engineers, Lenders, Contractors, Regulators, Off-takers, Environmental Management Professionals, Sociologists and Lawyers. This program is intended for Government Advisors, transaction advisors, lenders, professionals working in Power Generation and Transmission Agencies of Government, Auditors, Contractors, Regulators in the Energy, Natural Resource Management, Financial and Planning sectors of Government and entities involved in monitoring the performance of such PPPs. The course participants are expected to gain insight of the regulatory frameworks and legal issues of PPPs; negotiation and drafting PPPs agreements, role of transaction advisors in structuring PPPs, the effective allocation of risks between the Public and Private sectors in such deals in order to ensure financial sustainability and find optimal capital structures that bridge budgetary constraints and deliver best value for money.
